The Uneasy Relationship Between Human Rights and Public Health:

Lessons from Covid-19 

Achieving a proper integration of individualistic concerns (e.g. human rights) and collective concerns (e.g. public goods) has been a persistent problem in public health. One of the insights of the late Jonathan Mann, in heading WHO's response to the AIDS global epidemic, is that these two sorts of concerns need not be seen as inherently conflicting, but that public goods can be best secured through a strategy that respects human rights, e.g. to privacy and liberty of the person. However, as John Fabian Witt has observed in his American Contagions: Epidemics and the Law from Smallpox to Covid-19, the reconciliation of rights and public goods achieved in the response to AIDS was largely a function of contingent factors associated with the nature of that particular virus. The 'contingent' reconciliation is not so obviously applicable in the case of an infectious disease like covid-19, partly because of the nature of the disease, but partly also because of the availability of digital technology for identifying it and suppressing its spread that need not work through individual consent. This talk will seek to draw the lesson that we need a more stable reconciliation of rights and public goods in this domain.
